App Terms & Conditions

1. Acceptance of Terms

Welcome to the LocalBoost mobile application (the “App”), provided by LocalBoost LLC (“LocalBoost,” “we,” “us,” or “our”). By downloading, installing, accessing, or otherwise using the App, you (“you,” “your,” or “User”) agree to be bound by these Terms & Conditions (the “Terms”).

If you do not agree to these Terms, do not download, install, access, or use the App. If you have already downloaded or installed the App, please uninstall it and discontinue use immediately.

These Terms apply to all Users of the App, including business owners, their employees, contractors, and any other individuals granted access to an account. By using the App on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. Description of Service

LocalBoost LLC provides a white-labeled mobile business management application built on GoHighLevel's Lead Connector platform. The App allows local service business owners and their staff to manage and operate key aspects of their business from a mobile device, including:

• Managing contacts and leads, including importing, organizing, and tracking prospective and existing customers.
• Scheduling and managing calendar appointments and bookings.
• Conducting two-way conversations with contacts via SMS, email, and phone calls directly within the App.
• Managing sales pipelines and opportunities, including tracking deal stages and values.
• Processing payments and invoicing through integrated third-party payment processors.
• Requesting, monitoring, and responding to customer reviews.

We may modify, suspend, or discontinue any feature of the App at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuance.

3. Eligibility & Account Registration

You must be at least 18 years of age to create an account and use the App. By registering an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

To use the App, you must register for an account using credentials provided to you by LocalBoost LLC or your authorized reseller. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

You are solely responsible for maintaining the confidentiality and security of your account credentials (including usernames, passwords, and any access tokens) and for all activity that occurs under your account. You agree to notify us immediately at admin@localboost.build if you become aware of any unauthorized use of your account or any other security breach.

Each account is intended for use by the business and its authorized staff. You may not share your account credentials with individuals who are not authorized users of your business, and you are responsible for all activity conducted under your account.

4. User Responsibilities & Acceptable Use

You agree to use the App only for lawful business purposes and in a manner that does not violate any applicable local, state, national, or international law or regulation. You are solely responsible for all content and communications you send, store, or process through the App, and for obtaining all necessary consents from your contacts before messaging or calling them.

When using the App's messaging, calling, and email features, you must comply with all applicable laws and regulations governing electronic communications, including but not limited to the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. This includes, without limitation:

• Obtaining prior express written consent from recipients before sending any marketing or promotional text messages or making automated calls, as required under the TCPA.
• Including clear identification, a valid physical postal address, and a functioning opt-out/unsubscribe mechanism in all commercial email messages, as required under CAN-SPAM.
• Honoring opt-out and unsubscribe requests promptly and maintaining records of consent.
• Not sending messages or making calls to any individual who has opted out or requested to be removed from your communications.

You agree NOT to use the App to: (a) send unsolicited or spam messages; (b) engage in any unlawful, fraudulent, harassing, defamatory, or abusive activity; (c) upload, store, or transmit any content that infringes the intellectual property or privacy rights of any third party; (d) attempt to gain unauthorized access to any part of the App, its systems, or any third-party systems connected to it; (e) introduce viruses, malware, or any other malicious code; or (f) interfere with or disrupt the proper functioning of the App or the servers and networks it relies on.

LocalBoost LLC reserves the right to suspend or terminate access to the App for any User who violates these acceptable use requirements.

5. Subscriptions, Billing & Cancellation

Access to the App is provided under a subscription plan. The specific plan, fees, billing cycle, and payment terms applicable to your account are those agreed upon between you and LocalBoost LLC or your authorized reseller at the time of subscription.

Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually) until cancelled. All fees are non-refundable except as expressly stated in your subscription agreement or as required by applicable law.

You may cancel your subscription at any time by contacting us at admin@localboost.build or through your account settings, if available. Cancellation will take effect at the end of your current billing cycle, and you will retain access to the App until that time.

We may change our subscription fees upon reasonable advance notice. Any fee changes will take effect at the start of your next billing cycle following the notice.

6. Intellectual Property

The App, including its design, features, software code, branding, graphics, and all related intellectual property, is owned by LocalBoost LLC and/or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App except for the limited right to use the App in accordance with these Terms.

You retain all ownership rights in the business data, contact information, and content that you upload, create, or transmit through the App (“User Content”). By using the App, you grant LocalBoost LLC and its underlying platform providers a limited license to host, store, transmit, and process your User Content solely as necessary to provide the App's services to you.

You represent and warrant that you have all necessary rights to your User Content and that your use of it through the App does not violate any third-party rights.

7. Third-Party Services & Integrations

The App is powered by GoHighLevel's underlying CRM and communications infrastructure. Certain features of the App depend on, and are subject to the terms and policies of, GoHighLevel and other third-party providers.

Payment processing features are provided through integrated third-party payment processors. LocalBoost LLC does not directly store or process full payment card data; such data is handled by the applicable payment processor in accordance with its own terms and security standards.

SMS, email, and calling features rely on third-party telecommunications carriers and service providers. Message and call delivery is not guaranteed, and carriers are not liable for delayed or undelivered messages or calls. Standard message and data rates charged by your mobile carrier may apply.

LocalBoost LLC is not responsible for the acts, omissions, availability, or performance of any third-party service provider. Your use of any third-party service in connection with the App is also subject to that provider's terms and policies.

8. Disclaimers & Limitation of Liability

THE APP AND ALL SERVICES PROVIDED THROUGH IT ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LOCALBOOST LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LocalBoost LLC does not warrant that the App will be uninterrupted, error-free, secure, or that any data stored or transmitted through the App will not be lost or corrupted. You are responsible for maintaining appropriate backups of your business data.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOCALBOOST LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF LOCALBOOST LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LOCALBOOST LLC ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO LOCALBOOST LLC FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

9. Termination

You may stop using the App and cancel your account at any time by contacting admin@localboost.build.

LocalBoost LLC may suspend or terminate your access to the App at any time, with or without cause and with or without notice, including if we believe you have violated these Terms or any applicable law.

Upon termination, your right to use the App will cease immediately. We may delete your account and associated data in accordance with our data retention practices and applicable law. You are encouraged to export any business data you wish to retain before termination, as access to the App and your data may not be available after termination.

Provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, and governing law) shall remain in effect after termination.

10. Governing Law

These Terms and any dispute arising out of or related to them or the App shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

You and LocalBoost LLC agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any dispute, claim, or controversy arising out of or relating to these Terms or the App.

11. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. We will endeavor to provide notice of material changes, such as by displaying a notice within the App or notifying you by email.

Your continued use of the App after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App and cancel your account.
